1. Acceptance of Terms

By accessing or using 97 Questions ("Service"), including the website at simplemonth.com and the application at app.97questions.com and any related sites or platforms, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Description of the Service

97 Questions is a subscription-based digital experience designed for couples. The Service provides a set of questions and tools intended to support reflection and conversation between partners. The Service is provided for personal, non-commercial use only. We do not guarantee any particular outcome from using the Service and we do not provide professional relationship, legal, or medical advice.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement. The Service is intended for use by two people in a romantic or committed relationship who consent to participating together.

4. Accounts and Security

You may need to create an account to use the Service. You agree to provide accurate and complete information and to keep your account credentials secure. You are responsible for all activity under your account. You may not share your account with others except as intended by the Service (e.g., inviting a partner to join your couple). 5. Subscriptions and Payment

Access to the full Service may require a paid subscription. By subscribing, you agree to pay all applicable fees as described at the time of purchase. Subscription fees are billed in advance (e.g., monthly or annually) and are generally non-refundable except as required by law or as stated in our refund policy.

Your subscription will renew automatically at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or the platform through which you subscribed (e.g., Apple App Store, Google Play, or our website at simplemonth.com). Cancellation will take effect at the end of the current billing period; you will retain access until that date.

We use third-party payment processors (e.g., Stripe, Apple, Google) to process payments. Your payment and billing are also subject to those processors' terms. Price changes will apply to subsequent billing periods; we will give you notice where required by law.

6. User Content and Conduct

You may submit answers, messages, and other content through the Service ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a limited license to use, store, and display it as necessary to operate the Service (e.g., to show your answers to your partner, to back up data, and to improve the Service). We will handle your User Content in accordance with our Privacy Policy.

You agree not to use the Service to harass, abuse, impersonate, or harm others; to distribute spam or malware; to violate any law or third-party rights; or to attempt to circumvent the security or access controls of the Service. We may remove User Content or suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to that collection and use. If you are in the European Economic Area, United Kingdom, or other regions with applicable data protection laws, you may have additional rights as described in the Privacy Policy.

8. Intellectual Property

The Service, including its design, text, graphics, questions, and software (excluding your User Content), is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service or our content except as expressly permitted by these Terms or with our prior written consent.

9. Termination

You may stop using the Service at any time. You may request account deletion by following the process described on our Delete Account page. We will process deletion requests in accordance with our data retention practices and applicable law.

We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, for non-payment, or for any other reason we deem necessary to protect the Service or other users. Upon termination, your right to use the Service ceases. Sections that by their nature should survive (e.g., disclaimers, limitation of liability, governing law) will survive termination.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. 97 QUESTIONS IS NOT A SUBSTITUTE FOR PROFESSIONAL COUNSELING, THERAPY, LEGAL, OR MEDICAL ADVICE. USE THE SERVICE AT YOUR OWN DISCRETION AND RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 97 QUESTIONS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless 97 Questions and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or any law or third-party rights.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts. If you are in a jurisdiction that requires a different governing law or dispute resolution mechanism, the foregoing applies only to the extent permitted.

14. Changes to the Terms

We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may also be communicated by email or in-app notice where appropriate. Your continued use of the Service after the effective date of the changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and may request account deletion.
